In this Privacy Policy, we explain the types of personal data we collect, how we collect it, what we use it for and who we share it with.

ARTICLE 1 – WHO WE ARE

ARTICLE 2 – THE PERSONAL DATA WE PROCESS AS DATA CONTROLLERS
What is personal data?
Personal data is information that makes it possible to identify you:
- directly, such as your name or e-mail address; or
- indirectly, such as your customer number or IP address.
What types of personal data do we collect and process as data controllers?
The data we collect falls into two categories: (a) data that you provide to us, and (b) data that we collect through automated means.
- About the personal data you provide to us
We collect and process the personal data you directly provide to us when you:
- Fill in forms on our website or send us an e-mail to join the association.
- Subscribe to our newsletter to be kept up to date with our latest brand news, features, and events.
- Request to receive media releases or other press inquiries.
In this context, we collect and process personal data such as:
- Your identification and contact details, such as your name (first name, last name), position, company name, e-mail address and telephone number to provide you with information about our products and services, answer your questions, provide you with quotes, etc.
- The content of our interactions with you (requests for information, answers, quotes, etc.).
- Your responses to surveys that we might ask you to complete.
Some of these data are mandatory, others are optional. The mandatory or optional nature of the personal data to be provided is indicated at the time of collection. If you refuse to provide the mandatory data, we will not be able to process your request.
- About personal data we collect by automated means
When you use our website, we use automated technologies such as cookies to collect data from your computer or mobile device (phone or tablet) to enable the proper functioning of our website, measure and improve the performance of our website, and provide you with personalized content and advertising.
In this context, we collect your navigation information such as:
- Your device and connection ID (IP address, MAC address), information about the browser and operating system used, etc.
- Your use of our website, notably referring/exit pages, date/time stamp, and/or browsing actions.
ARTICLE 3 - HOW WE USE YOUR PERSONAL DATA?
We collect and use your personal data in the following ways:
- For marketing purposes, to send you our newsletter when you sign up to it or express your consent to the use of your e-mail address to keep you up to date with our latest brand news, features and events. You can unsubscribe from our newsletter at any time by clicking on the unsubscribe link at the bottom of each e-mail or directly make a request at: hello@arianee.org.
- To deposit cookies that are not necessary for the proper functioning of our website if you expressly consent to such processing.
- For the following purposes based on our legitimate commercial interest:
- To ensure the proposer functioning of our website.
- To ensure the security of our networks.
- To improve our products and services and develop new ones.
- To monitor service quality and provide training for our staff.
- To prevent and fight against fraud, notably computer fraud (spamming, hacking, etc.).
- To carry out statistics.
- To defend our interests in court.
- To comply with our legal obligations.
ARTICLE 4 - HOW LONG WE KEEP YOUR PERSONAL DATA?
We only retain your personal data for the following periods:
- For users of our website: navigation data is stored for a maximum 25-month period.
At the end of the periods mentioned above, some of your personal data will be archived, in a dedicated archive with restricted access, in compliance with our legal obligations and to defend our rights and interests in court, for the following periods:
- 10 years from the end of the accounting period for data kept for accounting purposes, as well as for commercial documents (invoices, purchase orders, commercial correspondence, etc.).
- In the event of pre-litigation, until the dispute is settled out of court or, failing that, as soon as the corresponding legal action becomes time-barred, it being specified that, under French law, the common law limitation period in civil and commercial matters is 5 years.
- In case of litigation, until the ordinary and extraordinary remedies are no longer available against the decision rendered.
At the end of this additional period, your remaining personal data will be permanently deleted from our systems or anonymized.
ARTICLE 5 - WITH WHOM WE SHARE YOUR PERSONAL DATA?
We do not rent or sell your personal data to any third parties.
We may share your personal data with:
- Service providers we use to support our business and provide our services (for example, hosting and maintenance service providers for our website, service providers in charge of sending e-mails and newsletters, fraud management service providers, etc.). These entities are bound by contractual obligations to keep personal information confidential and can use it only for the purposes for which we disclose the information to them.
- Our subsidiaries for the purposes outlined in this Privacy Policy.
- Other companies to which we could sell or assign all or part of our activities. You will be notified via e-mail and/or a prominent notice on our website of any change in ownership or uses of your personal data, as well as any choices you may have regarding your personal data.
- The administrative or legal authorities or any other authorized third party to comply with our legal obligations.
ARTICLE 6 – PERSONAL DATA TRANSFERS
Personal data that we collect from you may be stored and processed in, and transferred to, countries outside the European Economic Area (EEA). For example, this could happen if one of our service providers is located in a country outside the EEA. These countries may not have data protection laws equivalent to those in force in the EEA.
If we transfer personal data outside the EEA this way, we will take the necessary steps to ensure that your personal data continues to be protected in compliance with the applicable laws and regulations, notably by only transferring your personal data to businesses established in countries recognized by the European Commission as providing an adequate level of protection for your personal data or to organizations with whom we have entered into contractual arrangements to ensure an appropriate protection of your personal data, including the European Commission standard contractual clauses or that commit themselves to applying a code of conduct or a certification mechanism validated by the competent European authorities.

ARTICLE 7 – CHOICES AND RIGHTS THAT ARE AVAILABLE TO YOU REGARDING THE USE OF YOUR PERSONAL DATA
You may exercise the following rights regarding the use of your personal data:
- Right of access: you can obtain information about the processing of your personal data and a copy of these personal data.
- Right of rectification: if you believe that your personal data is inaccurate or incomplete, you may request that it be amended accordingly.
- Right to erasure: you can demand the erasure of your personal data to the extent permitted by law.
- Right to limitation of processing: you can request the limitation of the processing of your personal data.
- Right to object: when this right is applicable, you can object to the processing of your personal data, for reasons related to your particular situation. You have the absolute right to object to the processing of your personal data for commercial prospecting purposes, including profiling related to such prospecting.
- Right to the portability of your data: where this right is applicable, you have the right to have the personal data you have provided us with returned to you or, where technically possible, transferred to a third party.
- Right to withdraw your consent: if you have given your consent to the processing of your personal data, you have the right to withdraw it at any time.
- Finally, in some cases, notably when you reside in France, you have the right to establish general or specific directives concerning the processing of your personal data in the event of your death and to modify them at any time.
You can exercise the rights listed above:

- by sending an e-mail to privacy@arianee.org.
When you exercise any of your rights above, we have 1 month following receipt of the request to respond. This period may be extended by 2 further months, where necessary, depending on the complexity and number of requests. In such case, we will inform you of any such extension within 1 month of receipt of your request, together with the reasons for the delay.

The changes will be effective upon ARIANEE’s publication of the updated Privacy Policy.
Therefore, we recommend that you read this Policy regularly.
